On Saturday, September 28th, at 2:00 p.m., the Town of Cuba Police Department arrested Kaine D. Bunker, 22, of Belfast, for Grand Larceny 4th (E Felony), 2 counts of Burglary 3rd (D Felonies) and 3 counts of Petit Larceny (Misdemeanors).  The charges are the result of a 3 month long investigation stemming from 4 separate complaints of theft and burglary in the Village of Cuba that occurred in July, 2019.  The complaints involved the alleged break-ins of multiple vehicles and garages in the Chamberlain Park area.  Bunker was processed and issued an appearance ticket to appear in court at a later date.  Bunker is presumed innocent until proven guilty in a court of law.

And today an incident proved him all too right as a rat fell from the ceiling in the White House press briefing room and landed on an NBC reporter.
The rodent took a fall and landed square in the lap of NBC News White House correspondent Peter Alexander.
He calmly tweeted, “In other news: A mouse literally fell out of the ceiling in our White House booth and landed on my lap.”

Obituary: Robin Barry Rhodes, 71, formerly from Wellsville

Robin Barry Rhodes passed away on September 14, 2019 at the Wayne T. Patrick Hospice House in Rock Hill, SC.

Born on April 14, 1948 in Plainfield, NJ, he was the son of Harold and Margaret Macnab Rhodes.  On June 5, 1971, he was married to Mary Johnson in Plainfield.
Robin was a member of the Plainfield High School class of 1966.  He graduated from Newark College of Engineering in 1972, and later could not bring himself to recognize the school’s name change to New Jersey Institute of Technology.
Robin was employed in 1971 by Isothermics Inc. in New Jersey.  He moved his family to Wellsville, NY in 1977, taking a position as an engineer at CE Air Preheater.  He earned his MBA at St. Bonaventure University in 1983. Robin later became Vice President of Sales and Service at Air Preheater where he worked until his retirement in 2012.  Robin was awarded many patents for his work at both companies.
He was member of the Wellsville Country Club and the Wellsville Elks Club. He was a Past President of the Wellsville Lions Club, participating in many Lions functions and particularly enjoying the spring fishing derby.  He was instrumental in the formation of the Lions Diabetes Clinic at Jones Memorial Hospital.
Robin enjoyed fishing, pool, and golf.  He made an award-winning bowl of chili with at least 60 ingredients. After his retirement, he began making wine at home and found great joy in sharing it with old and new friends.
His daughters share fond memories of their Dad “helping” them with math homework, which usually turned into a lesson that went far beyond the assignment.  They enjoy, and still use, their Dad’s classic acronyms that few people knew how to translate.  Robin raised two critical thinkers who he inspired to think outside of the box by his dislike of the excuse “but, we’ve always done it this way”.  
Robin was predeceased by his parents and infant sister Peggy Lou. He is survived by his wife, Mary, and two daughters, Meredith Rhodes of Madison, WI and Jessica (Brad) O’Connor of Tega Cay, SC.  He is also survived by a sister Carol Ann (Dennis) Wenrick of Santa Rosa Beach, FL, and two brothers Burgess (Audrey) Rhodes of Powhaton, VA and Ronald (Kathie) Rhodes of South Plainfield NJ, grandchildren Claudia and Clayton Carson of Madison, WI and Nora O’Connor of Tega Cay, SC.
The family is planning a celebration of Robin’s life at the Wellsville Elks Club on October 18th.  Burial will be in Woodlawn Cemetery, Wellsville NY.

CORNING MAN PLEADS GUILTY TO POSSESSION OF CHILD PORNOGRAPHY

ROCHESTER, N.Y. – U.S. Attorney James P. Kennedy, Jr. announced Tuesday that Robert W. Wood, 49, of Corning, NY, pleaded guilty before Chief U.S. District Judge Frank P. Geraci, Jr. to possession of child pornography. The charge carries a mandatory minimum penalty of 10 years in prison, a maximum of 20 years, and a $250,000 fine.

Assistant U.S. Attorney Meghan K. McGuire, who is handling the case, stated that in 2011, the defendant was convicted of possession of child pornography and sentenced to 24 months in prison and 15 years supervised release. While on supervised release, members of the U.S. Probation Department made an unannounced visit to Wood’s residence and found an unauthorized smart phone in his possession. A search of the phone revealed that the defendant was in possession of over 2,300 images and over 20 videos of child pornography, some of which depicted the sexual abuse of infants and toddlers. The plea is the result of an investigation by the Federal Bureau of Investigations, under the direction of Special Agent-in-Charge Gary Loeffert, and the U.S. Probation Department, under the direction of Chief Probation Officer Anthony SanGiacomo. Sentencing is scheduled for January 10, 2020, before Judge Geraci.

Governor Cuomo Announces Second Phase of Raise the Age Law Now in Effect

Governor Andrew M. Cuomo Tuesday announced that the second phase of the Raise the Age law is in effect, creating a fairer and more equitable justice system by removing 17-year-olds who have committed criminal acts from automatically proceeding as adults in the criminal justice system. The change was effective midnight on October 1. Those youth will now be treated in age- and developmentally-appropriate ways and will receive needed services and treatment to avoid re-offending. The first phase of Raise the Age, implemented one year ago, similarly removed 16-year-olds from the adult criminal justice system. Raise the Age provides opportunities for diversion and community-based services for 16- and 17-year-old youth who can safely remain in their communities. 
“Raise the Age is now fully implemented, righting the injustice of treating teenagers as adults and successfully meeting our youth justice policy objectives,” Governor Cuomo said. “By fully implementing the second phase of Raise the Age, 16-year-old and now 17-year-old youth are required to receive the evidence-based services and treatment they need to prevent them from re-offending and to prepare those returning to the community to be successful and productive citizens.”
“We raised the age of criminal responsibility to remove 16- and 17-year-olds from the adult criminal justice system and place them in settings with proper services and treatment,” said Lieutenant Governor Kathy Hochul. “We are proud to champion this cause of ending the injustice of treating teenagers as adults. The second phase of the law will now include 17-year-olds to extend justice and fairness to those who are held before trial simply because they cannot make bail. We will continue to fight to ensure that all New Yorkers in all communities are given equal opportunities to live their lives to the fullest.”
When the court orders pre-trial or pre-sentencing detention, youth are now housed in one of seven secure or six specialized secure detention facilities statewide instead of in adult jails. Youth sentenced to less than one year may also be placed in specialized secure detention.
Two Department of Corrections and Community Supervision (DOCCS) facilities have been adapted to house 16- and 17-year-old adolescent offenders with sentences longer than one year. The facilities provide services and programming specially designed for adolescent offenders.
Raise the Age also provides for former justice-involved individuals to have their records sealed if they have remained conviction-free for 10 years. Since this provision took effect in October of 2017, 1,013 individuals have successfully petitioned the courts to have their cases sealed, thus removing barriers to employment, housing and other opportunities. This provision does not apply to individuals sentenced for violent felony offenses, class A felonies, sex offenses or those with sex offender status.
The success of the first phase of the Raise the Age implementation would not have been possible without the work of a multi-agency team including the Office of Children and Family Services, Division of Criminal Justice Services, State Commission of Correction, DOCCS and the Division of the Budget. The team also worked closely with the Unified Court System and local stakeholders. OCFS partnered with the State Education Department to develop educational plans for youth in detention and placement. The multi-agency group will continue to do so for this second phase of implementation, working with localities to help them comply with the law, providing technical assistance, guidance and support throughout the state for county and local governments.
